AGREEMENT


1. SUBJECT OF THE AGREEMENT

1.the organization of technical and vocational education assumes the responsibility of the employer for the full provision of educational services by passing the final certification of the student by organizing the educational process in the specialty corresponding to the mandatory state standard of education of the Republic of Kazakhstan, adopted on the basis of a state educational order in accordance with the needs of the employer, issuing him the appropriate qualification and a document on technical and vocational education.

2.the employer undertakes to provide graduates who have graduated from the organization of technical and vocational education on the basis of a state educational order with work in accordance with their respective qualifications and pay wages in the monthly amount established at the enterprise.


2. THE EDUCATIONAL ORGANIZATION UNDERTAKES THE FOLLOWING OBLIGATIONS: :

1) enrollment of students under the state educational order on the basis of the results of the competition;

2) when entering into a contract, familiarize the student with the Charter of the educational organization,internal regulations and other regulatory legal acts,basic requirements for organizing the educational process;

3) ensuring the organization of the educational process in accordance with the requirements of the law of the Republic of Kazakhstan "on education" ;

4)development and coordination of educational programs with the enterprise,creating safe conditions for the student,determining the amount of training load and the mode of classes;

5) information resources of the library of the educational organization,

ensuring the availability and use of textbooks, educational and methodological complexes,teaching aids;

6)providing the student with the opportunity to use computer equipment to perform tasks within the framework of educational programs in accordance with the conditions provided for in individual instructions approved by the head of the educational organization;

7) Organization of professional practice of a student in accordance with the curriculum of the educational organization;

8) prevent the student from participating in public and other activities that cause damage to the educational process without their consent;

9)providing the student with the opportunity to voluntarily participate in scientific, cultural and sports events in the educational organization, as well as in international scientific, cultural and sports life;

10) taking measures to preserve the contingent studying under the state educational order;

11) providing the employer with information about the student's academic achievements;

12)assignment of qualifications and issuance of a document of technical and vocational education to the student based on the results of the final certification and successful completion of the full course of training;

3. EDUCATIONAL ORGANIZATION:

1) require the student to perform their duties in good faith and proper manner in accordance with this Agreement and the internal regulations of the educational organization, as well as to monitor the order of study, correctly and respectfully treat teachers, employees and students of the educational organization;

2) take measures of influence on students for violation of the educational procedure, the terms of this Agreement, and internal regulations;

3) require the student to take care of the property of the educational organization, observe the rules for working with computer and other equipment. In case of material damage caused by the actions of the student, demand compensation for the costs of its restoration in accordance with the procedure provided for by the current legislation of the Republic of Kazakhstan;

4) encourage and reward students for their achievements in Educational, Scientific and creative activities;

5) termination of the agreement for reasons such as violation of the educational order, violation of the internal regulations of the educational organization and the Charter of the educational organization, non-performance of the obligations of the agreement, transfer to another educational organization, as well as the presence of other conditions provided for by the current legislation of the Republic of Kazakhstan.


4. THE COMPANY UNDERTAKES THE FOLLOWING OBLIGATIONS::

1) providing the student with safe working conditions at the workplace (with the implementation of mandatory labor safety and labor protection options) and, if necessary, training the student in safe Labor methods;

2) providing the educational organization with jobs for the student to complete professional practice in accordance with the academic calendar;

3) enrollment of students in the direction assigned to professional practice in the specialty in accordance with the terms of this agreement;

4) prevent the student from participating in public and other activities that cause damage to the educational process without their consent;

5) providing qualified specialists to supervise the student's professional practice in departments (departments, workshops, laboratories, etc.);

6) creation of necessary conditions for the possibility of using laboratories, offices, workshops, libraries, drawings, technical and other documents for the full assimilation of the Professional Practice program by the student at the workplace;

7) employment of a graduate who has studied under a state educational order in accordance with his / her qualifications in the position specified in the company's needs and ensuring payment of wages not less than 1 monthly minimum wage established by the current legislation of the Republic of Kazakhstan;

8) for non-compliance with subparagraph 7) of the agreement, the employer is obliged to reimburse the corresponding budget costs.

5. enterprise:

1) request information about students ' academic achievements;

2) participate in the development of educational programs;

3)determine the amount of the student's academic load and the mode of classes in accordance with the current standards through breaks;

4) require compliance with production regulations, labor regulations, internal regulations, and safety regulations that are mandatory for employees of the enterprise;

5) report to the educational organization all cases of violation by the student of the internal regulations of the enterprise and labor discipline in the course of professional practice;

6) require the student to take care of the property of the enterprise, observe the rules for working with equipment.

In case of material damage caused by the actions of the student, demand compensation for the costs of its restoration in accordance with the procedure provided for by the current legislation of the Republic of Kazakhstan;

7) encourage and reward students for their achievements in Educational, Scientific and creative activities;

8) participate in the work of the commission for the distribution of the state educational order for training personnel in the system of technical and vocational education.


6. LIABILITY OF THE PARTIES

1.the parties are liable for non-performance or improper performance of the obligations stipulated in this agreement in accordance with the legislation of the Republic of Kazakhstan.



7. DISPUTE RESOLUTION PROCEDURE

1.disputes and disagreements arising in the course of the execution of this Agreement shall be resolved directly by the parties in order to make a mutually beneficial decision.

2.disputes that are not resolved through negotiations and mutually beneficial solutions are resolved in accordance with the current legislation of the Republic of Kazakhstan.








8. TERM OF THE AGREEMENT, TERMS AND CONDITIONS

PROCEDURE FOR MODIFICATION AND ITS VIOLATION

1.this agreement comes into force from the date of its signing by the parties and is valid until its full execution.

2.the terms of this Agreement may be amended and supplemented by mutual written consent of the parties.

3.this agreement is drawn up in three copies in the state and Russian languages with the same force of law, one copy is issued to each party.
